MONTROSE - The Colorado Court of Appeals has rejected Jetaway Aviation's appeal of the July 2011 District Court ruling involving the company and Montrose County.
Last year, the district court ruled in favor of Montrose County's revocation of JetAway's "throughout the fence" access to the Montrose Regional Airport. That ruling also prevented JetAway from providing aircraft maintenance services under the "through the fence" agreement.
The District Court's ruling was based on JetAway's persistent violation of airport directives and the court's orders regarding operations on airport property, according to Montrose County.
The Court of Appeals also awarded the county attorney fees incurred in defending against JetAway's appeals.
In the 2011 District Court proceedings, Montrose County was awarded $242,534 in attorney fees and costs. JetAway, however, has separately appealed that award to the Colorado Court of Appeals.
